1. Agreement to Terms
By accessing and using truepoxynation.com (the "Website") or engaging our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Website or services.
These Terms constitute a legally binding agreement between you and Tru Epoxy Nation. Please read them carefully.
2. Services
Tru Epoxy Nation provides custom epoxy flooring and countertop installation services for residential and commercial properties ("Services"). All Services are subject to:
Availability and scheduling
Project scope agreement
Written contract and deposit
Appropriate weather and environmental conditions
Surface suitability assessment
We reserve the right to refuse service to anyone for any lawful reason.
3. Service Areas
We primarily serve Atlanta, Georgia and the surrounding metro area. We are available for select commercial projects nationwide. Contact us to confirm we serve your location.
4. Quotes and Estimates
Free Consultations:
We provide free, no-obligation consultations and estimates. During the consultation, we will:
Assess your space and surface conditions
Discuss design options and preferences
Provide a detailed quote
Quote Validity:
Quotes are valid for 30 days from the date provided unless otherwise specified in writing.
Final Pricing:
Final project costs may vary from initial estimates based on:
Actual surface conditions discovered during preparation (cracks, moisture issues, substrate problems)
Changes to project scope, size, or design requested by you
Additional materials or labor required
Unforeseen complications or structural issues
We will communicate any significant price changes and obtain your approval before proceeding with additional work.
5. Deposits and Payment
Deposit:
A deposit (typically 50% of project total) is required to:
Secure your project date on our schedule
Order materials specific to your project
Cover initial labor and preparation costs
Deposit amounts and terms will be specified in your written project contract.
Payment Terms:
Remaining balance is due upon project completion and your satisfaction
We accept the following payment methods: Cash, Zelle, Credit Card, Bank Transfer & Wires
Payment must be received before we leave the job site unless other arrangements are made in writing
Late Payments:
Late payments (more than 7 days past due) may result in 1.5% monthly interest charges
Unpaid balances may be sent to collections
You will be responsible for all collection costs, attorney fees, and court costs
Cancellation Policy:
Cancellations 7+ days before scheduled start date: Full deposit refund minus $100 administrative fee
Cancellations 3-6 days before start date: 50% deposit refund
Cancellations less than 3 days before start date or after materials are ordered: No deposit refund
No-shows or inability to access work site: No deposit refund; may be charged full project amount
6. Project Scope and Timeline
Your Responsibilities:
You agree to:
Provide accurate measurements, photos, and project information
Clear and prepare the work area as instructed (remove furniture, belongings, etc.)
Ensure unobstructed access to the work site on scheduled dates
Provide access to electricity and water if required
Keep pets and children away from work areas during and after installation
Maintain appropriate temperature (typically 50-90°F) and ventilation during application and curing
Follow all post-installation care instructions
Notify us immediately of any concerns or issues
Our Responsibilities:
We will:
Perform work in a professional, skilled, and timely manner
Use quality, professional-grade materials appropriate for your project
Protect surrounding areas from damage during work
Communicate proactively about project progress and any issues
Clean up the work area upon completion
Provide care and maintenance instructions
Project Delays:
Project timelines are estimates and may be affected by:
Weather conditions (temperature, humidity, rain)
Material availability or delivery delays
Surface condition issues requiring additional preparation
Client-requested changes or additions
Unforeseen circumstances beyond our control
We will communicate any delays as soon as possible and work to minimize impact on your schedule. We are not liable for consequential damages resulting from project delays.
Access to Property:
You grant us permission to access your property during agreed-upon times. If access is denied or unavailable on scheduled dates, you may be charged a trip fee and rescheduling fee.
7. Warranty and Guarantees
Workmanship Warranty:
We warrant our workmanship for one (1) year from project completion date against defects in installation, provided that:
Proper maintenance and care procedures are followed as instructed
No unauthorized repairs, modifications, or coatings are applied
The surface is used for its intended purpose
Normal wear and tear is excluded
What the Warranty Covers:
Delamination or peeling caused by installation defects
Coating failure due to improper application
Adhesion problems caused by our workmanship
What the Warranty Does NOT Cover:
Damage from improper use, abuse, neglect, or accidents
Damage from improper cleaning methods or harsh chemicals
Damage from unauthorized repairs or modifications
Normal wear and tear, scratches, or surface marks from use
Damage from impacts, heavy loads, or sharp objects
Damage from extreme temperatures or environmental conditions
Color fading from UV exposure (exterior applications)
Surface issues caused by underlying structural problems, moisture, or substrate failure
Damage from failure to follow care and maintenance instructions
Acts of nature, flooding, fire, or other events beyond our control
Material Warranty:
Materials are warranted by their respective manufacturers according to the manufacturer's terms. We will assist with any manufacturer warranty claims but are not responsible for manufacturer defects.
Warranty Claim Process:
To make a warranty claim:
Contact us in writing (email or letter) with photos of the issue
We will schedule an inspection within 14 days
If the issue is covered, we will repair or remedy it at no charge
Warranty repairs do not extend the original warranty period
8. Limitation of Liability
To the fullest extent permitted by law:
Our total liability for any claims arising from our Services is limited to the total amount you paid for the Services
We are not liable for indirect, incidental, consequential, special, or punitive damages including but not limited to:
Lost profits or business
Property damage not directly caused by our work
Delays or inability to use the space
Emotional distress
Third-party claims
We are not responsible for delays caused by circumstances beyond our reasonable control (weather, material shortages, pandemics, natural disasters, etc.)
We carry liability insurance, but our liability is limited as described above
Some states do not allow limitation of liability for consequential damages, so these limitations may not apply to you.
9. Surface Conditions and Disclaimers
Pre-Existing Conditions:
We will assess surface conditions during consultation, but some issues may not be visible until preparation begins:
Subsurface cracks or damage
Moisture or water infiltration
Previous coatings or contamination
Structural integrity issues
If significant issues are discovered, we will notify you and provide options, which may include additional costs.
Concrete Disclaimer:
Concrete is a natural material that may develop:
Hairline cracks over time due to settling or temperature changes
Color variations or efflorescence
Surface imperfections
While we take steps to minimize these issues, we cannot guarantee that concrete will not crack or change over time. Epoxy will follow these natural changes.
Color Variations:
Colors may appear different in person than in photos or samples due to:
Lighting conditions
Screen display settings
Batch variations in materials
Application techniques (especially in artistic designs)
We will do our best to match your expectations, but minor variations are normal and not considered defects.
10. Intellectual Property
Our Content:
All content on this Website, including text, images, logos, designs, and photographs, is the property of Tru Epoxy Nation and protected by copyright and trademark laws.
You may not:
Copy, reproduce, distribute, or republish our content without written permission
Use our name, logo, or branding without authorization
Claim our work as your own or use it for commercial purposes
Project Photography:
We retain the right to photograph completed projects for marketing purposes (website, social media, advertising) unless you specifically request otherwise in writing before project commencement. We will not include personally identifiable information without your permission.
If you prefer privacy, please notify us in writing, and we will not photograph or publish your project.
Your Content:
By submitting photos, testimonials, or other content to us, you grant us a non-exclusive, royalty-free license to use that content for marketing purposes.
11. Website Use
You agree to:
Provide accurate and complete information in all forms and communications
Not use the Website for any unlawful or unauthorized purpose
Not attempt to interfere with, damage, or compromise the security of the Website
Not transmit viruses, malware, spam, or harmful code
Not scrape, copy, or harvest data from the Website using automated means

13. Disputes and Governing Law
Informal Resolution:

Mediation:
If we cannot resolve the dispute informally, we agree to attempt mediation before pursuing legal action. Both parties will split mediation costs equally.
Arbitration:
If mediation fails, any dispute will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in Gwinnett County, Georgia.
Small Claims Court Exception:
Either party may bring a claim in small claims court instead of arbitration if the claim qualifies.
Class Action Waiver:
You agree to bring disputes on an individual basis only, not as part of a class action or representative proceeding.
Governing Law:
These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles. Any legal action must be brought in the courts of Gwinnett County, Georgia.
14. Indemnification
You agree to indemnify, defend, and hold harmless Tru Epoxy Nation, its owners, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:
Your breach of these Terms
Your misuse of our Services or Website
Your violation of any law or third-party rights
Your negligence or willful misconduct
Damage to property not caused by our work
15. Force Majeure
We are not liable for delays or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:
Acts of God (earthquakes, floods, storms, etc.)
Pandemic or epidemic
Government restrictions or regulations
Labor disputes or strikes
Material shortages or supply chain disruptions
Utility failures
16. Insurance
We maintain appropriate liability insurance for our business operations. Proof of insurance is available upon request.
17. Permits and Compliance
We will obtain any necessary permits or licenses required for our work. You are responsible for ensuring that the project complies with local zoning, homeowner association rules, or building codes specific to your property.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
19. Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us.
20. Assignment
You may not assign or transfer these Terms or your rights under them without our written consent. We may assign our rights and obligations under these Terms without restriction.
21. Entire Agreement
These Terms, along with our Privacy Policy and any written project contracts, constitute the entire agreement between you and Tru Epoxy Nation regarding our Services and supersede all prior agreements, understandings, or representations.
22. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Effective Date." Material changes will be communicated via email if you have provided us with your email address.
Your continued use of our Website or Services after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using our Website and Services.
